1. COPYRIGHT AND OWNERSHIP

• i. All photos and videos produced by Aurora Photography Sydney are protected by the Copyright Designs and Patents Acts. Accordingly, the copyright of these materials rests solely with Aurora Photography Sydney (ABN - 21868086834)

• ii. Purchasing of images or video does not transfer the copyrights. It merely grants the client personal usage rights.

2. USAGE AND DISPLAY PERMISSION

​

• i. By hiring us, the client(s) grant Aurora Photography Sydney the right to use and display any photograph or video covered by this contract for promotional, advertising, and any other purposes deemed fit by the photographer.

• ii. The photographer respects the clients' privacy. Should there be any image or video the client wishes to keep private, this should be communicated in writing to Aurora Photography Sydney.

3. CREATIVE DIRECTION AND COVERAGE

​

• i. Aurora Photography Sydney retains the right to artistic discretion. This means that the photographer will decide the style and direction of the shots taken.

• ii. We always prioritize our client's preferences and will make every effort to accommodate specific requests or suggestions.

• iii. Despite meticulous care with equipment, unforeseen technical malfunctions can occur. Aurora Photography Sydney is not liable for any image or video loss due to technical issues beyond our control.

4. PAYMENT AND PRICING POLICY

​

• i. To confirm your booking, a non-refundable fee equalling 50% of the total package cost is required. This booking fee indicates your agreement to the terms herein and will be subtracted from the final invoice.

• ii. The remaining balance is payable before the event starts.

• iii. Goods and services remain the property of Aurora Photography Sydney until payment is made in full.

• iv. Travel costs may be applicable based on event location and will be communicated transparently.

• v. Urgent bookings, those made within 24 hours of the event, will incur a 10% surcharge.

• vi. Events scheduled on public holidays will have an additional 5% surcharge.

5. FORCE MAJEURE

​

• i. Should Aurora Photography Sydney be unable to fulfil its commitments due to unforeseen circumstances beyond control, such as illness, accidents, or other emergencies, liability is limited to the refund of all fees paid.

• ii. In such circumstances, we will endeavor, but cannot guarantee, to recommend a replacement photographer or service provider.

6. DIGITAL NEGATIVE FILES AND FORMAT

​

• i. Digital negatives remain the property of Aurora Photography Sydney.

• ii. All packages include edited digital negatives for the client's non-commercial use.

• iii. Loss or damage of digital negatives due to circumstances beyond our control will result in a refund of fees paid but excludes goods already received.

7. EXCLUSIVITY AND EVENT BEHAVIOR

​

• i. Aurora Photography Sydney will serve as the exclusive professional photographer for the event. However, we welcome and encourage guests to capture their own memories.

• ii. For safety and to ensure protocol adherence, disruptive behaviors by attendees might result in shooting limitations.

8. CANCELLATION POLICY

​

• i. Should client(s) cancel a booking, the following policies apply:

  • More than four weeks from the event: Full refund, excluding the non-refundable booking fee.

  • Less than one week from the event: Refund excluding the non-refundable booking fee.

9. DELIVERY AND TIMELINES

​

• i. Clients receive High Definition JPEGs via an online gallery (Google Drive). RAW files remain the property of Aurora Photography Sydney, but can be negotiated for an additional fee.

• ii. Online galleries will be ready within two weeks post-event, excluding public holidays.

• iii. Final image delivery: two-three weeks post-event.

• iv. Video and highlights delivery: eight-twelve weeks post-event.

10. DATA STORAGE AND RETRIEVAL

​

• i. After the client receives their USB copy, online galleries will be deleted. Clients are encouraged to backup their data.

• ii. Aurora Photography Sydney retains a copy of the final JPEGs. Lost files can be retrieved for a nominal fee.

11. DELIVERABLES

​

• i. For solo photographer bookings, clients can expect around 50-60 post-processed JPEGs per hour.
